1. The agreement
These Terms of Service ("Terms") form a legal agreement between you and Blue Collar Funded ("BCF," "we," "us"). By creating an account, purchasing a product, or using bluecollarfunded.com, you agree to these Terms. If you don't agree, don't use the service.
If you are using the service on behalf of a business, you represent that you have the authority to bind that business to these Terms.
2. Your account
- You must provide accurate information when creating an account and keep it current.
- You are responsible for maintaining the security of your password and for all activity under your account.
- One person or business per account. Don't share login credentials with people outside your business.
- Notify us immediately if you suspect unauthorized access to your account.
3. Products & services
BCF sells:
- Manuals — digital downloads (PDF). Delivered via tokenized download links sent by email after purchase.
- Websites — design and development services. Delivered through our intake-and-build workflow with a typical turnaround of 3–5 business days after intake submission.
- Apps — Class B software apps (e.g., Proposal Builder, CRM, Dispatch). Sold under two pricing models per SKU: (a) one-time purchase, intended for self-hosted install on a contractor's own BCF-hosted website; (b) monthly subscription, hosted on BCF infrastructure at
/app/{name}/. - Recurring services — done-for-you services like hosting, SEO, ad management, social posting. Billed monthly via Stripe.
- Branding and profile setup — design files (logos, business cards, vehicle wraps, yard signs) and profile setup services (Google Business Profile, directory listings).
Specific scope, deliverables, and turnaround for each product are described on the relevant product page in the catalog. Where a product description and these Terms conflict, the product description controls for that product.
4. Payment, subscriptions & renewals
- All payments are processed by Stripe in U.S. dollars. By providing payment information, you authorize us (through Stripe) to charge you for the products you purchase.
- One-time purchases are charged immediately at checkout.
- Subscriptions renew automatically at the end of each billing period (typically monthly) until you cancel. By subscribing, you authorize the recurring charges.
- Cancellation: You can cancel a subscription at any time through your billing portal. By default, cancellation takes effect at the end of the current paid period — you keep access through what you've already paid for. You may also choose immediate cancellation (no refund of the partial period).
- Refunds: See our Refund Policy for the specific terms by product type.
- If a renewal payment fails, we'll retry per Stripe's standard retry schedule. If it ultimately fails, your access will be suspended until you update your payment method.
- We reserve the right to change prices on a going-forward basis. Existing subscribers will be notified at least 30 days in advance of a price change taking effect on their renewal.
5. License to use BCF software & manuals
Subject to your compliance with these Terms and payment of applicable fees:
- Manuals are licensed for the purchaser's personal and business use. You may print copies for your own use. You may not redistribute, resell, or post the content publicly.
- Subscription apps (Tier 2, BCF-hosted) are licensed for use during the active subscription period for the named business. Access ends when the subscription ends.
- Self-hosted apps (Tier 1, one-time purchase) are licensed for installation on a single contractor website. Each purchase covers one site. To install on additional sites, additional licenses must be purchased.
- You may not reverse-engineer, decompile, or extract source code from BCF apps except to the extent that applicable law expressly permits.
- You may not use BCF code, designs, or content to build competing products for resale.
BCF and its licensors retain all rights not expressly granted in these Terms.
6. Your content and data
- You own your content. Anything you upload (logos, photos, business information, customer records, estimates, project data) remains yours.
- You grant BCF a limited license to host, process, and display your content as necessary to deliver the services you've purchased.
- For BCF-hosted apps, you can export your data through built-in export functions or by emailing admin@bluecollarfunded.com. After cancellation, your data remains accessible in read-only mode for a reasonable period before being archived or deleted.
- You are responsible for ensuring you have the right to upload any content you submit (including photos, copy, and customer information).
7. Acceptable use
You agree not to:
- Use the service for any unlawful purpose or in violation of any applicable law.
- Attempt to gain unauthorized access to other customers' accounts, BCF systems, or related infrastructure.
- Disrupt or interfere with the service, including overwhelming our servers with automated requests.
- Upload malware, spyware, or content that is fraudulent, defamatory, infringing, or otherwise harmful.
- Use the service to send spam or bulk unsolicited communications.
- Resell BCF services as your own without an explicit written agreement.
We reserve the right to suspend or terminate accounts that violate these standards.
8. Third-party services
BCF integrates with third-party services that have their own terms:
- Stripe — payment processing, billing portal. stripe.com/legal
- Brevo — transactional and marketing email delivery.
- Domain registrars and hosting providers — for websites we build and host.
- Google, Yelp, Angi, etc. — for profile setup services.
BCF is not responsible for the policies, practices, or availability of third-party services.
9. Warranty disclaimer
BCF works hard to deliver high-quality products and reliable service. That said, the service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any defects will be corrected.
10. Limitation of liability
To the maximum extent permitted by law, BCF, its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, arising out of or in connection with the service.
Our total liability for any claim arising out of these Terms or the service is limited to the amount you paid to BCF in the 12 months preceding the claim.
Some jurisdictions do not allow exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless BCF from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of: (a) your use of the service; (b) content you upload; (c) your violation of these Terms; or (d) your violation of any third-party right.
12. Termination
- You can cancel your account at any time by emailing admin@bluecollarfunded.com or by canceling all active subscriptions through your billing portal.
- We may suspend or terminate your account for material breach of these Terms, fraud, or non-payment, with notice where reasonable.
- On termination: your access ends, but your data remains available for export for a reasonable period, and any obligations that by their nature survive termination (license, intellectual property, liability, indemnity) remain in effect.
13. Governing law
These Terms are governed by the laws of the United States and the state where Blue Collar Funded's principal place of business is located, without regard to conflict-of-law principles. Any dispute arising out of these Terms will be resolved in the state or federal courts of that jurisdiction, and you consent to the personal jurisdiction of those courts.
14. Changes to these terms
We may revise these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Material changes will be communicated by email to active customers at least 14 days before they take effect. Continued use of the service after the effective date means you accept the updated Terms.
